CAT tells govt to strip employee of ST benefits

HYDERABAD: The Central Administrative Tribunal (CAT) on Wednesday directed the Union finance secretary and the Hyderabad zone chief commissioner of central excise to withdraw all the benefits extended to a non tribal employee under the Scheduled Tribe (ST) quota.

The bench comprising CAT’s vice chairman justice P Lakshmana Reddy and administration member R Santhanam, while delivering its verdict on a petition filed by a retired administrative officer of central excise, however, set aside the order issued by the authorities dismissing her from service for furnishing a fake ST certificate to secure her job.

The petitioner, B Susheela Devi, claimed the scheduled tribe status and joined the department in 1971 as a lower divisional clerk (LDC) and in the next three decades rose to become an administration officer under the quota. When criminal proceedings were launched against her after it was found out that her Schedule Tribe status was not genuine, Susheela Devi opted to take voluntary retirement in 2004. But when the authorities rejected plea, she approached the A P High Court contending that it was her father who got her registered as belonging to scheduled tribe in school records and that she genuinely believed it. The high court, after taking a written undertaking that neither she nor her children would use the ST status in future, directed the authorities to drop the criminal proceedings against her.
The CAT too issued a similar direction to the authorities and asked the authorities to revert her status to open category (OC) and calculate her growth in accordance with that proposition.

Any promotions or incentives or benefits given to her under the ST quota should be taken back and pension fixed accordingly, the bench said and gave six months time to the authorities to implement the order.

'Govt employee has fundamental right to be considered for promotion'

The Supreme Court has ruled that a Government employee has a fundamental right to be considered for promotion and it is mandatory for the Centre and States to carry out cadre review of eligible officers for promotion to the Indian Administrative Service (IAS).
"The right of eligible employees to be considered for promotion is virtually a part of their fundamental right guaranteed under Article 16(Equality of opportunity in matter of public employment) of the Constitution," a bench comprising Justices R V Raveendran and A K Ganguly held in a recent judgement.
The apex court passed the judgement while directing the Centre and the UP Government to consider the promotion of two State cadre officers-Hemraj Singh Chauhan and Ramnawal Singh to the IAS.
"We hold that the statutory duty which is cast on the State Government and the Central Government to undertake the cadre review exercise every five years is ordinarily mandatory subject to exceptions which may be justified in the facts of a given case," the bench said.
Both the Centre and the UP government had challenged the direction of the Delhi High Court to consider the two officials' promotion due to them in 2003 since the cadre review exercise was undertaken by the State government only in 2005. This was done despite repeated reminders from the Centre.
The guarantee of a fair consideration in matters of promotion under Article 16 virtually flows from guarantee of equality under Article 14(Equality before Law) of the Constitution," the apex court said while upholding the high court's judgement.
The apex court ruled that state governments are under obligation to recommend names of its administrative officers every five years to the Centre for their promotion to the IAS and pulled up the UP government for failing to do so despite several reminders from the Union Government.
The court said that a government cannot deny an eligible state officer from being promoted due to the delay on its part in conducting such exercise and pulled it up for "lethargic" approach resulting in two state officers being denied promotion.
"It is clear that legitimate expectations of the state officers of being considered for promotion has been defeated by the acts of the government and if not of the Central Government, certainly the unreasonable inaction on the part of the state government stood in the way of the officers' chances of promotion," the court said.
"The Court is satisfied that in this case for the delayed exercise of statutory function the Government has not offered any plausible explanation. The state officers cannot be made in any way responsible for the delay," the court added.

Don't dismiss personnel while appeal is pending: CAT

New Delhi, Mar 24 (PTI) The Central Administrative Tribunal (CAT) has advised the Delhi Police against terminating services of personnel who are already convicted for an offence but whose appeals are still pending before higher courts.

The Tribunal passed the order while giving relief to a former Delhi Police constable, convicted in 2007 by a lower court but was granted bail by the Delhi High Court in 2009.

"Normally, a person who is undergoing imprisonment, will not be entitled to get reinstatement, as the two concepts do not go together. But that does not automatically mean that the Deputy Commissioner or Joint Commissioner were within their rights, to pass orders terminating the services of the applicant on the basis of the conviction, when an appeal was pending before the High Court," the Tribunal said.

NIO sets up paleomagnetic lab

Panaji, Mar 22 (PTI) In a bid to analysis data pertaining to environmental magnetism and magnetic stratigraphy (study of rock strata), the National Institute of Oceanography has set up a laboratory inside its premises here.

"The paleomagnetic (study of remanent magnetisation in rocks) laboratory facility, now available within the institute, is expected to be used frequently for detailed magnetic measurements of the sediment cores," according to NIO website.

The laboratory can help researchers in deducing meaningful geological interpretation, it states.

NIO is one of the 38 constituent laboratories of Council for Science and Industrial research (CSIR).

PM to launch NCL diamond jubilee on April one

New Delhi, Mar 22 (PTI) Prime Minister Manmohan Singh is expected to launch the diamond jubilee celebrations of the National Chemical Laboratory (NCL) in Pune on April one.

Singh is likely to address over 500 scientists pursuing research at NCL, a constituent of the Council of Scientific and Industrial Research (CSIR). The NCL was established in 1950.

Over the years, NCL has emerged as a key interdisciplinary research centre with interests in polymer science, organic chemistry, materials chemistry, chemical engineering, biochemical sciences and process development.

Maharashtra Chief Minister Ashok Chavan, HRD Minister Kapil Sibal, Science and Technology Minister Prithviraj Chavan will also be present on the occasion.

Singh is also expected to lay the foundation stone of the Indian Institute of Science Education and Research (IISER) building in Pune, official sources said.

Passport under Tatkal scheme

Applications for issue of passports under the Tatkal scheme are accepted if a verification certificate is submitted in the prescribed performa, duly signed by a designated officer of the Central/State Governments, or on submission of three prescribed documents. Two lists containing designated officers and prescribed documents are enclosed at Annexure A and B.

Generally, Passport Offices have adhered to the time-target of issuing passports under the Tatkal scheme. Under the scheme, fresh passports are issued within the time-target of 1-7 days and re-issued passports within three working days, subject to no adverse information being found in the system during the processing of the applications. The Government has elaborated a public grievances redressal mechanism to attend to all grievances, including those under the Tatkal scheme, at every passport office as well as at Consular, Passport, and Visa Division of the Ministry.

No regular pay scale for contractual posts: CAT

New Delhi, Mar 11 (PTI) The subsequent merger of a contractual post into a regular establishment of a government department will not entitle an employee to claim a regular pay scale, the Central Administrative Tribunal has held.

The Tribunal was hearing a matter of an ex-armyman Jai Ram Solanki, appointed on contractual basis, who demanded the regular pay scale associated with Office Superintendent after the regular establishment of MCD took over the post in 2001.

"The appointment was purely on contractual basis for a particular project with certain stipulations which included payment of a fixed remuneration. Thus, claim for a regular pay scale would not be tenable. Again, even the subsequent merger of the post in the regular establishment of the MCD would not give him any such right," it said.

Technology Development by CSIR

CSIR has formulated and operationalized 92 projects for the XIth Five Year Plan. These have been categorized into supra-institutional projects (32), network projects (44), inter-agency projects (6) and facility creation projects (10).

The Mid Term Appraisal recognized that CSIR has emerged as a model organization leading in cutting edge science on one hand and providing end to end technological solutions for economical and societal goods on the other. CSIR has refocused and reprioritized its R&D activities of XIth Plan responding to policy changes. Eight areas have been identified for focused R&D, deriving synergy. These are: Affordable healthcare; Sustainable energy; Chemistry & Environment; Smart & Functional Materials; Engineering structures/design and electronics; Earth System science; Information Technology and CSIR – 800 (S&T interventions for the masses.)

Koraput to have CSIR centre

BHUBANESWAR: Koraput will soon be connected to the nationwide network of Council of Scientific and Industrial Research (CSIR) laboratories as it is chosen as an extension centre to have a pool of master trainers to train grassroots-level people in applied technologies in various fields.The extension centre would be presently promoted by the State Government with an initial investment or Rs 30-40 lakh on a 25-acre land. However, it would soon have a full-fledged CSIR centre of Rs 40-50 crore investment with master trainers in agriculture, food and rural technologies, environment, biodiversity and food processing and for this a detailed proposal had already been submitted to the central authorities.It would have active support from Institute of Minerals and Materials Technology (IMMT), Bhubaneswar, Central Foodcraft Technology Research Institute, Mysore, Central Institute of Medicinal and Aromatic Plants, Lucknow, North East Institute of Science and Technology, Jorhat, and Central Salt and Marine Research Institute, Bhavnagar.According to IMMT Director Prof. Barada Kanta Mishra, the centre, to be built under `CSIR-800 Programme’ would also help in creating employment opportunity for the backward region in the southern part of Orissa which has seen a series of extremist activities recently.It would also work as an interface to transfer laboratory-based knowledge to the rural people.Mishra was speaking to mediapersons on the sidelines of `CSIR technology show for micro, small and medium enterprises’ here on IMMT campus during the sixth Entrepreneurs Week celebration.On the occasion, Science and Technology Minister Ramesh Chandra Majhi said though things are at a primary level, the proposed project would be ready within a year and would mainly help in promoting rural technologies for economic growth of the region famous for its rich biodiversity.Industries Secretary Sourabh Garg said our scientists must try to develop patented technologies for economic self-reliance so that we would not go to the West paying hefty sum in getting their R&D knowledge. He also said that the CSIR Director- General had assured all help for the Koraput centre.Regarding patents, the IMMT Director said till date the city-based institute has acquired 100 patents while another 100 are in the processing stage adding in a year scientists are applying for at least 15 patents on a regular basis.A day-long workshop and an exhibition on various technologies were also organised. Minimum wages in Delhi increased by 33%

New Delhi, Mar 8 (PTI) Unorganised sector workers in the national capital will now get 33 per cent enhanced wages.

The Delhi Cabinet today approved a proposal, paving way for enhanced wages to the workers.

Chief Minister Sheila Dikshit, briefing the media after the Cabinet meeting, said the daily wage of an unskilled worker has been increased to Rs 203 from Rs 163 while the wage of a semi-skilled worker has been fixed at Rs 225.

Dikshit said the daily wage of a skilled worker has been fixed at Rs 248.

For the clerical segment, the daily wage of an under-matric has been fixed at Rs 225 while daily wage of a graduate will be Rs 270.

Officials said the new wages approved by the Cabinet are "more or less" in the same range recommended by the central government.

Changes in the Recruitment Process of Civil Services Exam

The examination system of the Union Public Service Commission (UPSC) is updated from time to time to keep it in harmony with the changing environment. In regard to the Civil Services Examination (CSE) the Prime Minister has approved the proposal for introduction of Civil Services Aptitude Test (CSAT) in place of the existing Civil Services (Preliminary) Examination. The CSAT is expected to come into effect from Civil Services Examination, 2011.

This information was given by the Minister of State in the Ministry of Personnel, Public Grievances & Pensions, Shri Prithviraj Chavan in written reply to a question in Lok Sabha today.

Standardisation and Enhancement of Security Features in Cheque Forms
Paper-based cheque clearing continues to be one of the popular modes of initiating payment transactions in the country. During the period April-December 2009, clearing houses in the country have processed on an average around 4.5 million cheques every day. Several measures have been initiated by Reserve Bank of India to ensure that this retail payment product functions in a safe and efficient manner.
2. Introduction of Magnetic Ink Character Recognition (MICR) technology during the mid-eighties has been the single-most important development responsible for making the cheque clearing popular and efficient – volume-wise, speed-wise and convenience-wise. At the banks’ end too, cheques in MICR format have facilitated post-processing ease in operations, affording credit to customer accounts and reducing reconciliation issues, thus improving customer service. Standardisation of cheque forms (leaves) in terms of size, MICR band, quality of paper, etc., was one of the key factors that enabled mechanisation of cheque processing.
3. Over a period of time, banks have added a variety of patterns and design of cheque forms to aid segmentation, branding, identification, etc., as also incorporated therein a number of security features to reduce the incidence of cheque misuse, tampering, alterations, etc. Growing use of multi-city and payable-at-par cheques for handling of cheques at any branches of a bank, introduction of Cheque Truncation System (CTS) at New Delhi for image-based cheque processing, increasing popularity of Speed Clearing for local processing of outstation cheques, etc., are a few aspects that led to looking into the need, if any, for prescription of certain minimum security features in cheques printed, issued and handled by banks and customers uniformly across the banking industry.
4. Against the above backdrop, a Working Group was set-up by the Reserve Bank of India for examining further standardisation of cheque forms and enhancement of security features therein. The Working Group comprised various stakeholders viz. commercial banks, paper manufacturers, security printers, etc., apart from Reserve Bank of India. Recommendations of the Working Group were discussed internally as also forwarded to Indian Banks’ Association (IBA), National Payments Corporation of India (NPCI) and select banks for their views. The feedback from these institutions has been received and duly considered.
5. It has since been decided to prescribe certain benchmarks towards achieving standardisation of cheques issued by banks across the country. These include  provision of   mandatory   minimum   security  features   on   cheque  forms  like  quality  of paper, watermark, bank’s logo in invisible ink, void pantograph, etc., and standardisation of field placements on cheques. In addition, certain desirable features are also being suggested which could be implemented by banks based on their need and risk perception. The set of minimum security features would not only ensure uniformity across all cheque forms issued by banks in the country but also help presenting banks while scrutinising / recognising cheques of drawee banks in an image-based processing scenario. The homogeneity in security features is expected to act as a deterrent against cheque frauds, while the standardisation of field placements on cheque forms would enable straight-through-processing by use of optical / image character recognition technology.
6. The benchmark prescriptions shall be known as "CTS-2010 standard", specifications of which are annexed. Effective date of implementation of the standard will be advised to you in due course. It is our intention that the revised cheque standard is implemented by banks before the roll-out of CTS at Chennai. IBA and NPCI will be co-ordinating and advising banks on introduction of additional security features on cheques as also other aspects relating to implementation of the standard across the country.

Seniority not a fundamental right: CAT

New Delhi, Mar 5 (PTI) The Central Administrative Tribunal has refused to set aside an order by the MCD revising the seniority list of its junior stenographers, saying that it cannot be claimed as a "fundamental right".
"As per the settled law, seniority is not a fundamental right of a public employee. It is only a civil right. There cannot be any change in this contrary to the principles of natural justice," the Tribunal bench, comprising Members Shanker Raju and Veena Chhotray, said.
It dismissed the petition of junior stenographers seeking to set aside the order of the civic agency which had revised their 1988 seniority list.
The Tribunal noted that seniority list of junior stenographers was revised in 2000 by the MCD after duly considering the objections invited by it after circulating a provisional seniority list.

Scientist moves high court over award

KOLKATA: Calcutta High Court has admitted a complaint by scientist Srimanta Kumar Raut against the Council of Scientific and Industrial Research (CSIR) and the Human Resource Director General (HRDG) for not conferring upon him the Shanti Swarup Bhatnagar Award for 1992, in spite of his name being announced by the media.

While Justice Dipankar Datta has sought explanations from CSIR and HRDG by March 17, the development has brought out contradictory reactions from the Centre and University of Calcutta, where Raut was a reader in the department of zoology. While counsel for the central government told the court that CU had not provided necessary details about the scientist, those for the university wanted the matter dismissed as it dated back nearly 18 years.

The award named after the founder-director of CSIR is given every year for outstanding contributions in the field of science and technology. Raut is a life member of the National Academy of Sciences, India, and has been recognised for his research worldwide.

The scientist's counsel, Supradip Roy, told the court that Raut's name was announced as a winner by the media, including All India Radio and television channels, in October 1992. But on December 6, Raut came to know that he was not being given the award. Since then, the scientist has taken up the matter with CSIR, ministry of human resource development and CU but his grievance was not addressed. Raut also brought the matter to the notice of MPs but they were of little help. Finally, he moved court, contending that it was a clear violation of Article 14 that ensures citizens equality before law.

Raut claimed in his petition that he was awarded the Ashutosh Mukherji Prize in zoology in 1984. From 1985 to 2005, Raut got several diplomas, fellowships, associateships and other awards from various institutions.

Roy told the court that he had been told by CU that all formalities had been completed on its part and it was CSIR that should explain why Raut was not given the award.

CSIR rules state that the university would have to nominate names and give all details in a certain format for a scientist to be awarded. After lawyers for the Centre contended that the university had not done so, those for CU submitted that the matter should be dismissed.
